What Is Hemp & THCA?
Hemp is the cannabis plant containing no more than 0.3% delta-9 THC by dry weight — the federal 2018 Farm Bill standard, adopted into North Carolina law (Session Law 2022-32).
THCA (tetrahydrocannabinolic acid) is a naturally occurring compound in raw hemp flower. Because NC currently measures only delta-9 THC, hemp-derived THCA that stays under the 0.3% delta-9 limit fits the legal hemp definition today.

North Carolina Hemp & Kratom Law
Current status — updated July 6, 2026. General information, not legal advice.
Hemp, THCA & Delta-8
Currently legal in NC when no more than 0.3% delta-9 THC by dry weight (2018 Farm Bill; NC Session Law 2022-32). Heads up — this is changing: a federal law effective November 12, 2026 redefines legal hemp by total THC and caps finished products at 0.4 mg total THC per container. State bill HB 328 (pending) would add the same rule plus a 21+ purchase age. We stay current and compliant.
Kratom
Legal to buy and sell in North Carolina. State law (N.C.G.S. § 14-313.1) sets the minimum age at 18. No NC Kratom Consumer Protection Act is enacted yet (a bill, HB 468, is pending). No NC county or city bans kratom.
